Terms of Service

The legal agreement between you and Kast

These Terms of Service ("Terms") govern your use of the Kast application, website, and services (collectively, the "Service") operated by Kast ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Accounts

When you create an account, you must provide accurate and complete information. You are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

You must be at least 16 years old to use the Service.

2. Subscriptions and Payments

2.1 Billing

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for the applicable fees.

2.2 Free Tier

The free tier is provided as-is with limited features. We reserve the right to modify or discontinue the free tier at any time.

2.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods, except as required by law.

2.4 Price Changes

We may change subscription prices with 30 days' notice. Continued use after the price change constitutes acceptance.

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to systems
  • Interfere with the Service or other users
  • Engage in illegal or fraudulent activities
  • Stream content that violates others' rights

We reserve the right to suspend or terminate accounts that violate these terms.

4. Intellectual Property

4.1 Our Property

The Service, including its software, design, and content, is owned by Kast and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Service.

4.2 Your Content

You retain ownership of any content you stream through the Service. By using the Service, you grant us a limited license to transmit your content solely to provide the streaming functionality.

5. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect and use your information.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Kast and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

9. Modifications

We may modify these Terms at any time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

12. Dispute Resolution

Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kast regarding the Service.
